Paul Johnson, Lynn Johnson Public Records say Johnston Purchased a Property withheld from Probate

Frank Beardsley died and his children were his heirs. The youngest child, Robert, became the Executor. The family home was located at 694 Collyer and it was to be sold. 694 was sold to a family named Johnston and was sold on March 9. The title company affirmed that the sale was for the home at the amount offered. A mortgage was received by the family.
Probate documents show the same information.

Years later the Tax Assessor claims that this Paul Johnston and Lynn Johnston puchased two homes owned by Frank Beardsley. They did so on the same day and the home at 694 Collyer is now listed as a multiple home sale.

Johnston has been asked to provide information as to who he paid.

Johnston said he would immediatle get this clarified and it was made very clear to him that in the matter of an Estate, all information must be given to all the heirs. Mr. Johnston, if he found a mistake made by an Assessor, has not called back or written. We are 3000 miles apart so it would seem if he did not purchase a home without the authorization of one of two heirs, i.E., me, he might want to clarify this before his name goes to the Attorney General's Fraud Unit.

Under California Law, all property, even that in Trust, if belonging to a deceased, has to be reported to the Probate Court if there is a Probate. There are tax implications but also, the heirs have the right to know what has become of their parent's assets and has the right to know who has taken them and why.

When I spoke to Mr. Johnston I realized he sounded very much like my father's neighbor, George.

Hopefully Mr. Johnston will provide details about his role in the sale of the other real estate and I can update this report.
