Ripped Off by Sales Manager Promising Financing That Couldn't Be Done

A sad story about buying a car:

September 27th, I get run off the interstate and flipped and totaled my vehicle. That is the good news in this story.

In October I decide to buy a new car. Bill Heard was running a radio ad, so I went. Found a 7 seater van, just loved it.

Sales Manager says leave a $3000 post dated check to be cashed October 31st, drive it home.

1100 miles later, I get a call; oops your financing didn't go through. You have to show your mortgage is current. I reminded him that I told him I was refinancing my house in October and the mortgage broker had gotten pay off and told me not to pay the mortgage. Well then you bring the car back.

Instead of taking my check for three thousand, and leaving. Like an idiot, I agree to a Cobalt.

I get home, my husband hits the roof. We do after all have four children, and the Cobalt is a TINY car. So he calls the sales manager and says we have to bring this car back. Sales Manager says tough it's your car now.

So the Underwriter for the finance company calls me yesterday and says where's the $3000 down payment. I explain the post dated check.

He explains that his company's policy for finance contracts is cash in hand only and he has told Bill Heard he will not approve contracts that involve post dated checks.

So he sends the refused contract overnight back to Bill Heard.

I call the finance manager at Bill Heard and explain the financing has been refused and I need to bring the car back and get my check.

He states, you can bring the car back but we keep the $3000 check, you drove our cars and devalued them.

I state, your decision to put me in those cars without secured financing, I won't pay for that.

He says, we'll put the loan back through on the 31st, I said no, the underwriter will refuse this contract no matter how many times you send it to him, he knows the story on this car and he recommended a stop payment on the check because he said you would try and push the check through.

Finance Manager says I will be sued for the $3000 regardless if I have a car from their lot or not.

Called the Director of Customer Relations who told me he was hired to help Bill Heard recover their reputation. I explain to him, I hate the car, it's not the right car for me, I was taken advantage of, and I want to bring it back. He states he will have to have a senior manager call me. Called the Better Business Bureau and was told Bill Heard had someone they hired to deal with these specific cases. She is out of town until Thursday.

Some Five Hours later I have received no phone call and am preparing to take this Cobalt back.

I have no financing, they refuse to take the car back unless I pay them $3000 for driving these two cars they put me in without financing, and they do not seem to be very concerned that I am quite upset and feel very abused.

I go on the internet, to this site and find two more stories IDENTICAL to my own, in fact one is from Sherman who had this VERY SAME THING happen on October 20th of this year. He made Bill Heard come to his town to pick up the car and was told they would sue him for devaluation of the car.

Now that is messed up.

Surely there are enough of us to start a class action lawsuit against these crooks.
