My son signed a lease from July to June. He later decided to continue his studies elsewhere so he requested his lease be terminated promising to find people to take over his lease, which he did. The landlord requested that they send an application fee of $35 each before she faxes the application papers to them.

Even though she had received the application fees on July 5, the landlord opted to sign on some other tenant for Sept. Aug. lowering the monthly rent and requiring my son to pay for the difference.

My son paid July rent ($825) & was obligated to pay August rent (this could have been avoided if she had chosen his replacement tenants). He also had to forfeit the security deposit of $825 as liquidating damages. He abided with the terms of the lease agreement.

Now the landlord is demanding that my son pay $300 ($25/month during the l-year lease of the replacement tenant). She did not take into consideration that he had already paid two full months rent. She actually 'extended' my son's lease by another two months!

As I understood it in the terms of lease agreement, my son's lease terminated when she had signed on a replacement tenant and my son is not liable to the landlord for any monthly rent after the effective replacement date. She lowered the rent so that her replacement tenant can take over the lease.

To add insult to injury, she later admitted that she had other units available if my son's friends were still interested in an apt.!
