False Advertising/Failure to Honor Warranty/Fraud - Sharp LED TV

I purchased Sharp 60 in. LED TV from this online store. Advertised as "factory boxed", I assumed it was a new TV since their website states ALL merchandise is new. The TV was defective right out of the box. When I contacted them to request a replacement, Megastore tried to switch me to a different model claiming that they were out of stock on my model (even though their website still indicated stock of my model and accepted orders). I declined and they suggested I follow-up with Sharp warranty service. Based on the serial number, Sharp told me that the TV was a re-conditioned set and was no longer under warranty... But they offered me an upgrade to their newer version for $520. I contacted TVMegastore again and was told to pay for the upgrade and that they would reimburse me for my additional cost... After several weeks of e-mails and phone calls telling me "the check will be in the mail", to this date I've received NOTHING. I contacted the BBB and the NY City Attorney General's Office but have yet to see any money from TVMegastore. DO NOT buy from this company!
