Sales scam, paid them to create a website... 3 months later nothing was done

This is the response I recieved after requesting a refund months later, when they created nothing but a headache and they were supposed to create a website based on my website that I already have with another hosting company. Which apprarently was too hard for thier web designer to do. So, all I got was generic emails saying they will be working on my new website for months the same emails over and over again. Then they have a really great response for not giving a full refund in details, but thats how they make free money by ripping you off and they just sit and wait until you request a refund and bam they say too bad... See below.

Please be advised that this minimum cancellation fee to retain our hard costs is in place of the standard 50% that is consistent with the Terms of Service. On 06/14/07 you electronically accepted the Terms of Service (TOS) from your IP address: 72.130.229.24. Section 29 of the TOS establishes the policy regarding refunds. You can view the TOS at:

According to the TOS, Heritage is entitled to a 50% refund. Heritage feels that our decision of retaining only $149 instead of half of the fees collected is reasonable and fair. We had hoped this fairness would be reciprocated.
If you still feel a larger refund is due you, we would suggest that a neutral 3rd party assist in determining what is fair. The arbitration services offered by the BBB are designed for this very purpose. As a member of the BBB, we have found that the BBB is able to fairly and professionally resolve such differences.
We would like to recommend that your refund request be submitted to the BBB, as a neutral third party, and allow their decision to be legally binding on both parties. If this is acceptable to you, please respond by return email.
