Ripoff damaged clearance merchandise and NO REFUND!

I ordered a pair of clearance shoes from shoepeddlers.com. The shoes I received were scratched, so I filled out the report and told them to either send me a new pair of the same or I wanted my money back.

They told me that I could not get my money back, because they were clearance shoes, but it did not state that they were clearance because they were scratched. They are leather Danskos and I buy Danskos at the store and if they were scratched I would not purchase them. They stated that the scratches are normal, but I have never seen a leather shoe with scratches like that.

I don't want to buy anything else from them, because they can sell any quality of clearance shoes and then force you to spend more money at their company. This is how they get rid of damaged merchandise or suck you in to buy products from them.

I have been trying to call them or email them for about 4 months now and they refuse to respond to me, even though their phone message says they will repsond in 24 hours, they have not called me once and I have called them at least 10-15 times and emailed them every week, sometimes more.
