Phonestore USA - Ebay Seller Ripoff Sold me ebay buy now phone as brand new for $141.80 Then when it arrived found it was refurbished

I bought this phone on eBay from phone store usa they stated it was brand new upon arrival, I charged it and found the photo album had some pictures on it and someone else's recent calls. Verizon, took a look at it said was refurbished and I was ripped off this was not brand new as his add said never unpackaged. They found the battery back wasn't one for phone it had another persons info and service in Florida suggested may even have been hot and refurbished except they forgot to clear activate it. It kept loosing its picture and service.

I asked for a refund. No reply several times Ebay said to go to pay pal they agreed in my favor I returned it and gave them the tracking insurance number I insured its return then they ruled in his favor and closed the dispute it didn't match he said what he had. He is arrogant, and has done this to so many people on eBay and through pay pal and keeps getting away with it. People like him make buying on the net not worth the hassles and losses of money paid in good faith.

I told him I am going to report him where ever I can and may seek a lawyer he wished me Luck with the lawyer.
He even told me he would make the refund for the phone as soon as the pay pal dispute was done i have kept all mailings from him as evidence.

No one should buy from PhoneStore USA or this man. It is bad news. A fraud and rip off big time.
