Ebay fraudulent ripoff of a consumer listing an item based on false pretense

A case of consumer fraud issued against kirk higgins / kirknpattie@msn.com.

This, Kirk Higgins, sold a defective electronic under false pretense, claiming that it, in fact, worked. From the guy's initial auction-site, he claimed that the only reason he was selling this item was due to the fact that he purchased a newer electronic version of that similar device. Yet, from the very outset of the item's arrival, it was clear that this was not the case.

Upon contacting him in regards to the item's defectiveness, he tells I should adjust the tri-podswhich, just so happen, to be inside the actual body of the pedal itself: and can only be located by taking the actual pedal apart. Now, if this is, as he claimed, was the pedal he used, than why would it arrive in such a state that it would have to be opened up and adjusted? Would it not already be set?

Kirk Higgins stated that the item was working a couple of days before shipment. Seeing, a future dispute quickly forming, I took the item to a local authorized dealer who told me that the item could not have been damaged in shipment; it had to of been sent in that condition to begin with. Seeing how the damage was inside the item and could only be accessed by unscrewing four separate screws.

I informed the seller of this; and gave him until the next day to tell me whether, or not, he planned to issue a full refund. Otherwise I would have to leave feedback regarding his fail to reply; and, more inportantly, of the fraundulent activity he ascribed in.

Kirk Higgins is a fraudulent liar who is capable of ripping off anyone. This guy didn't stand behind his product and used unbecoming means to hawk his item.

But don't take my word for it; i'll freely send all his emails and auction web to any who so desire. His words will show this to be the case.
