According to a letter mailed 2/24/05 from the Division of Consumer Affairs of the State of New Jersey, the State of New Jersey settle its lawsuit Against Alyon Technologies, Inc. The major/important parts are contained in the following three paragraphs:

"The terms of the settlement require Alyon to provide better disclosure of its services, billing practices and right to dispute a bill. It also requires Alyon to use an identification number to prevent unauthorized use of its services and puts in place restrictions for the use of auto-dialers by the website providers. The settlement requires Alyon to provide restitution to eligible consumers; however, if your complaint was previously resolved, you will not received an additional credit or refund."

"You may be eligible for a credit or refund if you were billed for videotext services by Alyon or its billing agent for charges incurred on or before June 15. If you incurred such charges and submitted a billing inquiry to Alyon or filed a consumer complaint with the state on or before January 15, you will receive an automatic credit or refund. The refund will be issued in late February."

"You may also be eligible for a credit if you did not submit a billing inquiry or file a complaint, but it will require some action on your part. When you receive you next billing statement from Alyon or its billing agent, there will be instruction on the back of the bill advisaing you how to proceed with the dispute. You will be advised to download one the three different affidavits from either Alyon's website, www.Alyon.net or the FTC's website, www.ftc.org. You mut mail the completed affidavit to Alyon so that the company receives it within 45 days of the date on your billing statement."

That's the basics of what to do in NJ. I hope they don't do something bogus like mail the bill weeks after the due date. With my dealings with them, they mailed the bill after the due date so it was already "past due". It goes without saying that we never wanted or ordered the "services". I already sent my affidavit a long time ago and never got an answer from them, but the bills stopped, the collection agency stopped calling, and nothing happened to our credit. I guess I won, but I'm not throwing out all the materials and information in case they resurface. Good luck guys!
