Sprint provided poor quality HTC EVO - HTC EVO

I switched to Sprint 4/12 and received a HTC EVO. Virtually from the first day I have had problems with the phone. The phone gets so hot I can barely touch it, it redials numbers multiple times, it gives the incorrect time on texts received, if the texts are received at all I was given a new battery, advised to do a hard set, take the battery out, etc, nothing has worked.inquired as to my options I was told:

1. A tech would for $50 look at the phone, if there were no known issues from the manufacturer and nothing could be found wrong with the phone I would be given a replacement to the exact same type of phone. Why would I want the exact same phone when this one doesn't work?
2. Sell my phone for $16 and choose from an list of used phones that range from $19.99 to $120.00. The new phone I received doesn't work, why would I want a used one?
3. Pay $175 for an early upgrade the price of the phone. I'm due for an upgrade in 4 months, so why not just cancel the contract which would cost $140.00?

All I want is a phone that works, in order to keep a customer is it difficult to offer the early upgrade for less or an exchange of some kind. I feel Sprint really has not offered any viable options, I feel the only real option is to simply go elsewhere.
