Berkley Premium Nutraceuticals, Rip-Off Misleading and fraudulent offers with vauge instructions

The company in question offered a nationaly advertised product with a "free trial". The cost for shipping is all that was advertised on their website. That cost was $4.50. What they did not specify and I emphise that, is that a stipulation was added ambiguously at the point of the purchase. Since the buyer does not know of this stipulation beforehand, the purchase will probably be made. The 30 day trial was recieved and I was not satisfied with the product BUT at the end of the trial two more packages of the product was sent to me at a cost of $70.00, charged to the same credit card that I used to pay shipping on for the trial.

I called the company's Customer Service Center to notify them of the transaction and I was informed that I agreed (at the time I ordered) also to a 60 day supply of the same product. I told the representative that I do not recall making such a agreement with them online or otherwise and she insisted that I did stating that the stipulation was apart of the webpage order form that i filled out. Talking to the rep online, I reviewed the webpage order form and saw that there was no such stipulation. She then informed me that as of August 15th, that stipulation no longer existed. Since I could not recall something that I did online over a month before, they had me but they did tell me that since I had a Customer Service complaint, that they could reinburse me half of the billed amount from the charge on my credit card.

The representative also informed me that I had the opportunity to stop the 60 day re-order from occuring when I got the initial sample. That my sheet of instructions informed me of this. This may be so but this hussle works for the following reasons:

1. If you are interested in the original sample only and they specify that it is free, you do not expect anymore charges after the initial transaction.

2. When you recieve the initial product you are not obligated to read everything that is sent to you in packing.

3. You make the transaction over the Internet, not with a person to instruct you as to what to look for in the package. You may assume that the other stuff is stuff you dont wish to deal with.

The company realizes that most customers have tunnel vision and do not care about the other stuff that they send. The ignorance of the customer is not due to the lack of information they send.
The ignorance is due to the direct result of the customer not being obligated to read anything they send. The only thing that the customer should be interested in reading are the product instructions.

They realize that customers will call and complain and they offer you half the money back to settle you doen and still make 35 dollars in profit that you get back two weeks later. It's a hussle plain and simple. Let the trial buyers of the product Enzyte beware.
