Company now charging 40 dollars for a background check

I have worked for asp also known as asi 3 different times and now i figured with the bad economy why not try to supplement my income. So i will out and application and submit it.
Well i get contacted today by one of there HR reps and she said that now they are under new owners and requiring that you pay 40 dollars for a background check. I tryed to explain to her that i have worked form them before and see if it can be waived. So she calls her manager and asks they wont waive it for anything dont be taken by this scam.
Also i am doing some investigating of this companys practices on my own if anyone has any info for me please let me know the more info i have the better i can help people bring this company down.
