What a RIPOFF! - Samsung Behold II Cell Phone

I ordered a "NEW" Behold II. Received the phone really quickly. Though WOW, Great service. Boy, was I wrong. The phone is NOT NEW! Scratches all over the rear case. Wasn't even in the original packaging. There was a molded insert but the phone doesn't really fit. The charging cable was loose in the box. The plastic bag for the cable was under the cable. Nothing else in box but battery, charging cable and phone.
I have spoken and email the company numerous times. They do call back, but don't seem to follow through. The told me, whcn I contacted them on July 16, they would send a new back cover to me. Never arrived. Spoke ith them again July 30 and was assured they would send another out and supply me with tracking number. Have heard nothing since. No tracking number, no phone call, nothing.
