Cell phone not working - Sanyo Kyocera Zio

My cell phone is not working properly and I would like to know what cricket is willing to do to rectify the problem?
The phone gets very warm to the touch and it will not hold a charge. I have already taken the phone to one of your stores in my area and was told by "Ishmael" that since he could duplicate the problem ther was nothing he could do!
