ELECTRONIC STORE iPad virtual selling

On December 16th I entered into the “ABOLAFIA SINCE 1879 LLC” shop to buy an iPad for my daughter. The owner convinced me to buy another Tablet (a "Microsoft new one"), supposedly much more performing, even if more expensive (599$).
The owner formally committed to exchange with an iPad in case of dissatisfaction.
I quickly realized (the day after) that I had been sold a device which didn't answer my expectations. I went back twice to the shop to exchange the devise: No iPad available anymore …
I finally brought back the Tablet to the shop on December 27th before leaving for Louisiana, with the solemn promise that he would sent me the iPad in the following days.
I waited for the package during my stay in Louisiana.
I am back in Paris and still waiting for 2 months now…
Notwithstanding messages (sms) like “the package is in transit”, they are incapable to provide me with an evidence of the sending...
