I was sold brand new defective instrusment. Monster Cellular did not give me replacement under warranty. And did not fix my problem under warranty. Defective Product/No warranty as promissed

I bought brand new Motorola Razr V3 (Unlocked) from Monster Cellular Store via Ebay. I paid $ 98.98 to this store. I reported the battery problem to the store directly calling tool free number. I was sent new battery and still it did not solved the problem. I reported the problem via email and I was denied to replace the instrument and I was told to repair it. Due to family emergency I could not send the phone to Monster Cellular before 60 days. So I called to double check with them before I send it to them. They say they will check it out and fix the problem if there is a problem. I sent the instrument with battery to monster cellular and few days after I received email from them explaining there was no problem with the instrument and they are sending back to me. I received the phone but not the battery. I ended up new battery the same time and again my new battery went dead in same 1 call of 1 minute and 6 seconds. I reported the problem the same evening and I was denied by the person name Dan. That he is not going to replace the instrument because "from day you bought the phone we don't know what you did to the phone and I can not do anything in warranty" again no words for my battery they did not returned with the phone. And now they are not even answering my call.
The manufacturer's warranty is 1 year and Monster Cellular is only giving 60 days warranty. Isn't that abnormal? I should have thought about that before I made the deal with this store. They are simply selling the old re-furbished product with new label on it.
