Promised refund 3 times and still none

This document describes my experience with NewCalc (the vendor) and provides an argument for why I believe Capital One should dispute this transaction. This argument describes how Stephen, the NewCalc representative, fraudulently convinced me he would provide a refund and then progressively pushed back the refund date. The most condemning evidence against NewCalc is the fact that they shipped the calculator 5 days after they agreed to provide a refund. The following is a timeline detailing my experience with NewCalc.
On April 6, I ordered a calculator from Stephen at NewCalc after talking with him on the phone and was assured it would "ship quickly". I ordered the calculator for the PE exam I was to take on April 24.
April 21: I emailed Stephen asking to cancel my order and issue a refund because the calculator had not arrived in time to be of use in the PE exam.
April 22: Stephen replied to my email stating that the calculator may have already been shipped. He agreed to check the shipping status and provide a refund if the calculator did not arrive in the "next day or two."
April 24: I took the exam without the calculator ever arriving
April 30: I received a shipping notification (tracking # 9101128882300693975080) from PayPal stating the calculator was shipped on April 29 despite my request to cancel the order one week earlier.

May 8: I received the calculator from USPS (tracking # 9101128882300693975080)

May 11: I attempted to contact Stephen via email requesting information on how to return the calculator; however, Stephen never replied. Finally I got a hold of Stephen via telephone and obtained the return address.

June 17: I shipped the calculator (tracking #23050270000170297449) to the address provided.

June 19: USPS attempted to deliver the package and left a notice. USPS subsequently shipped the package back to me and lost it in the process.

July 18: I emailed Stephen inquiring why the package was not picked up.

July 22: Stephen replied asking if I would like a refund or replacement.

July 23: I emailed Stephen specifying that I would like a refund.

Sept 22: I emailed Stephen inquiring why the refund had not been issued.

Sept 28: Stephen replied requesting that I return the calculator before issuing a refund.

Sept 28: I emailed Stephen and re-explained the history of the transaction including the failure of NewCalc to pick up the package.

Sept 29: Stephen replied recanting his offer to provide a refund and suggested that I contact the postal service.

October 5: Stephen emailed again stating that he would give us a refund if the tracking number was valid. Again I provided it

Still no refund, just broken promises. Buyers Beware!!!
