Sold me a broken phone, would not take back, the phone broke within an hour of using it

I traded phones with this guy, Within one hour of having the phone it broke I wrote him an email, he replied telling me he was sorry but that he would not take it back. This is terrible service I feel the phone was sold to me faulty.
