Unordered phone mailed, then billed $95 for text messages

I received a Disney phone in the mail, I did not order, sent back not activated, charged 95 dollars for the text messages sent to the phone while in the mail, Disney is still billing me for the phone several phone calls have been made to the company. They keep saying they will take care of this well now it's on my credit record for owing a bill i did not order or activate I have sent to the Better Business Bureau and attorney general. How can they get away with this
