Sold Refubished TV as New Now Left with Nonworking TV

TV Purchase Details: We bought a Samsung LN-S4041D 40 LCD HDTV from Hi-Tech Stop on July 7, for $1,029.99.

New TV is Actually Refurbished: Our TV started malfunctioning in May. We contacted Samsung immediately since we knew that our new TV would still be under the one-year warranty. After providing the TV's serial number twice, Samsung informed us that our TV is refurbished. The TV was no longer under warranty and furthermore refurbished TVs are not serviced under warranty by Samsung. I further learned from Samsung Customer Service that our new TV has been serviced four times, two of which were major repairs. The Samsung representative shared that there is no way that Hi-Tech Stop thought the TV was new. After several phone calls to Samsung, they refused to service the TV because they were under no obligation to do so. We are now left with a non-working TV.

Hi-Tech Stop's Non-Response: I immediately contacted Hi-Tech Stop as they obviously fraudulently sold us a refurbished TV as a new TV. I have sent countless emails and phone messages and the company has not returned any of my calls or emails on this matter.

Consumer Law Violated: I want to stress that at no time were we aware that we were purchasing a refurbished TV. I know that by law, product packaging and receipts must state if an item is refurbished. There was no indication on the Hi-Tech Stop website, product packaging, or bill of sale that the TV is refurbished. Also refurbished products are generally sold at discounted prices but we paid market price. And lastly, I even followed up with Hi-Tech Stop via email in July to verify that the TV is new.in an email from Angelo from Hi-Tech Stop customer service he assured me that the TV is new.

False Warranty Claim: The Hi-TechStop site sates that it is a Samsung Power Partner which means that are under Full Manufacturer's Warranty (Attachment 3). The website reads, It covers the full service of Replacement Parts and the cost of Labor absolutely free of charge This obviously is not true.
