Corporate Office, case manager won't get back to me on warranty / lemon law issue

We bought a 50" Rear Projection Samsung DLP on April 7. We purchased a 1 year protection plan for it. Every year before the warranty was up, I would purchase another year. I thought I was doing the right thing keeping it covered.

My protection plan ran from 4/8/06-4/8/07 4/8/07/4/8/08

Besides the lamp burning out every now & then, the ballast had to be replaced on 2/21/07. (1rst major repair.) Lamps don't count as major repairs.

On September 20, light engine had to be replaced. (2nd major repair) Lamp was replaced as well.

On February 4th, light engine failed again. The part had to be ordered. Two weeks later, the Tech showed up and wanted to pull the part to send it out and have it repaired because the part is no longer available. That would also leave me without a Tv. I said no way.

I started reading my protection plan and read about the "NO Lemon Guarantee" I felt I qualified since this is my 3rd major repair. Ha!

After many calls and complaining to CC customer service, they connected me to a case manager, Veronica. She took all my info down and told me I qualified and she would get back to me. I know sooner hung up the phone when she called me back to tell me I DID NOT qualify. Even though no time had ever lapsed for coverage. The 1rst major repair was 2/21/07 and my new policy started 4/7/07. I missed it by a month.

The other two fall into this warranty period 4/7/07-4/7/08. But now I need a 3rd major repair before the 8th of next month. The next warranty period wipes out the previous 2 repairs and I start all over again.

Isn't a warranty a warranty? I'm paying every year to keep my TV covered and for what. It was a waste of money. After telling Veronica that was bull she put me through to Corporate offices. I spoke to Katharine who took all my onfo again. This was 2/29/08. I told her I could not find anything about the warranty period. She was going to find out from the Warranty Dept and get back to me on Monday.

Yep, you guessed it, She never called. I have called her all week all hours of day and night. Also I have called Veronica (case manager.) No one has called back. I left messages for them both, telling them about filing this report, filing a report with the Ma state cosumers affair, also the business bureau and last but not least filing for legal action.

While typing out this report, I received a call from a very rude lady from Corporate. I told her I had been dealing with Katharine and she had never heard of her. She said I did not qualify. One repair did not happen within the contract year. I asked her where in the policy does it state that? She said visit A circuit city store and ask someone there.

I paid from year to year for the contract because why would I want to buy a 3 year contract for $552.99 on a tv that has been a lemon since day 1. I didn't even like paying a year.

I am sitting here with a broken tv that won't even turn on. Like alot of you, I have purchased thousands of dollars worth of products from Circuit City and will NEVER again step into their store. I am going to make sure everyone I know aware of their warranty scam. I'm also going to call my local TV channel's to get it out there. I am in the market for a couple of Blu rays and a GPS. I'm going to Tweeter. Don't shop at circuit city!!!
