Nokia N95 Scamme

Wish I had read the previous review on Mark Ponn—but it was not up yet. I would have saved myself $100. What happened to me is exactly what has been reported here already.

This guy (or gal, whatever) offered me 10 Nokia N95s for $450 each, plus $10 shipping each. He accepts COD and PayPal for payment. His information didn't check out very well and so I didn't want to pay it all upfront, but I was willing to try COD.

I paid $100 through PayPal for shipping to ponnpaypalpaypal@aol.com. Once I paid he sent me an urgent email saying he needed me to pay the rest through PayPal and that he couldn't accept COD after all. I told him I was not willing to change the payment terms and to refund my $100. He then told me that he would, after all, accept COD, and I received a tracking number within 24 hours.

Once I received the tracking number I thought that he might actually be legit. For the remaining $4500 I obtained an official check. He shipped overnight through FedEx (tracking 790747162175). When it got here it was packaged in 5-6 FedEx boxes all held together by a FedEx bag. I opened up two of the boxes, and each one had an old, used, and worthless DVD in it plus lots of old, wadded up phone books. I refused the shipment, and thankfully did not lose the $4500.

I immediately filed a dispute and claim with PayPal and received this terse, cowardly message from them:

"Our investigation into your claim is complete. As stated in our User
Agreement, the claims process only applies to the shipment of goods. It
does not apply to complaints about the attributes or quality of goods
received. Therefore, we are unable to reverse this transaction or issue a
refund."

So, PayPal doesn't care if the seller ships you a bunch of useless phone books. So long as he ships SOMETHING—whether or not it's what you ordered—they will wash their hands and walk away.

BEWARE of this seller. He is an absolute scam!
