Ripoff! Fraud! HORRIBLE service, lying, Not honoring contract! Richmond

On 11/10/04 I purchased a samsung HCN529W 52inch rear projection TV. I purchased this at the Poughkeepsie, NY store. First off the tv was an open box, floor model, so I got it for 300 off list. I was excited. This is where the happy days end.

I later found out the TV was discontinued from Samsung because of repair problems. I was never told this during the sale, the salesman just kept saying what a great deal it was. Within 30 days of getting the tv in my house, the tv broke. Called circuit city for repair, said no problem someone would be there to fix later that week. A service rep from Stanton TV in Danbury CT, came and said it would be easier to fix if they brought it back to their shop, so I said no problem. (I just want to say that Stanton TV in Danbury had nothing to do with my problem, whenever I called them they were helpful and nice).

Anyway week one and two was the "the part is on backorder." Week three and four I spent going back and forth with Circuit City, Stanton TV, and Samsung. Long story short the part isn't available, Circuit City sold me a discontinued Television. City Circuit is willing to give me an exchange, which I DO NOT WANT. I want my money back, but they refuse to give it to me, stating it is passed the 30 days of purchase.

I could not bring back the TV to circuit city, as i didn't have it in my possession, because it was at an authorized circuit city repair center, I thought getting fixed. How the hell can they say it is my fault that i didn't bring back the TV which i didn't have in my possesion!!! Please help i am losing my mind as circuit city is hands down the worst store EVER, and after this is over i will NEVER spend another cent in their horrible stores. How this company can treat its customers like this and get away with it is amazing.
