Withdrew $ from checking account without authorization twice, which incurred overdraft fees. Did not sign up for the service

I applied for a payday loan, stupid, yeah. Apparently I was denied but Identity Theft took it upon themselves to enroll me in their program. I did not authorize this. They claim that their application is tied into the payday loan and that I willing applied for their service. No, I did not. I called and called and called. I still have not talked to a live person. I when on their chat, and low and behold, no one was there. I called, left a message to cancel and that I want a refund. I went online and cancelled there and again stated that I wanted a refund plus the overdraft fee. Guess what, they withdrew another $31.98 eight days after the first withdrawal and AFTER I cancelled.
I finally got someone on the chat and she basically told me that I can do nothing and that I will never prove that it is fraud on their part.
This is what she typed "As stated in our terms, if the application is proven to be fraudulent you will be refunded in full. You will need to follow our fraud resolution policy. You will need to contact your local police station and file for identity theft, once you have a copy of the report you can fax it in to us at 1-888-385-2668 and we will be able to provide the officer working on the case withall the information needed to trace the application back to the person who applied for it. Once it has been proven the application does not trace back to you we will be refunding your account in Full."
Ok, first, the application was automatic when applying for a payday loan, which I admit I did. I did not apply for Identity theft. I applied for a payday loan. Second, I have not been given nor know where their terms are. Third, isn't this the very thing they are selling?
