John C. Bain Rail Head Club denied a claim I made for Job insurance when I was taken out of service on the Union Pacific Railroad working as an Engineer

I began paying monthly premiums of 50.00 to Rail Head Club to pay for the time I may become suspended by the Union Pacific Railroad I work for if I were to accidently break an operating rule. This began in 2000.

On December 18 I was operating a train west of Cheyennne, Wyoming when I went by a red light without stopping and was pulled out of service. I imediately contacted Rail Head Club and told them. There was an investigation and I sent those results to John C. Bain, my contact with Rail Head Club and they reviewed these documents. They determined that I deliberately violated the rule and my claim for 200.00 per day was denied.

My suspension is for four months and I will return to work April 17. I was counting on this money in case I got suspended. This is why I took out the policy and paid the premiums. What is interesting is this organization pays for two deliberate acts that no other job insurance pays for in the industry. Rule 'G' violations which are, working under the influence of alchohol and for insubordination. My case was deemed an accident by the union pacific officer in charge and not deliberate.

I was counting on this coverage in the event I needed this. This is the only such claim I have made in my entire 30 years on the job. I would like my claim overturned and get the money I have coming.
