I found Mr. Dustin Cox on craigslist selling a Nintendo Wiis at the time which also included the game Need for Speed for $350 plus $14 for DHL shipping. He stated that the console and game were NIB (new-in-box) and factory sealed with the Target receipt, which was to be included.

Initially we corresponded via email; after approximately three (3) emails I gave him my cell phone number in order to speed up the process. Each time I would call him he was quick to answer the phone and each time he sounded like a legitimate businessman who has "sold" things online before.

After speaking with Dustin a few more times I decided to purchase the Wii from him for the designated price of $364 (shipping included).initially, I was going to send him a cashier's check through my credit union, however, he suggested a personal check from of his banks he had accounts with (Wells Fargo or Washington Mutual) because he wanted to be sure that there would be no lag time in order for him to get the funds. I kindly obliged and sent a WAMU check in the designated amount via Express Mail on December 31.

On January 2 he acknowledged that he had received the check and that it was "good" and that he was going to be shipping it out through DHL that day where he would then email me the tracking number. He emailed me later that day stating that his wife had just shipped it and as soon as she came back that he would then give me the tracking number - he never emailed me the tracking number.

On January 4 he emailed stating that DHL tried to deliver it to me and missed me, so they were going to be shipping the package (Wii) back to him.in addition, he asked what I wanted to do since he couldn't "pay for shipping twice."

I then called DHL, only to find out that they never send back a package after a single attempt, but instead, will attempt at least three (3) more deliveries prior to contacting the recipient, and possibly sending it back to the sender. I emailed Dustin with this information, and stated that I still wanted him to send the Wii and that I was willing to pay the additional shipping IF DHL did in fact send it back to him. His reply was that he sent a cashier's check to me in an undesignated amount that I was to receive in the "next couple of days" because he was "gonna sell it to someone down [there]."

On January 8 I emailed Dustin stating that I had not received the check yet as well as inquired as to the amount of the check - he replied on January 12 with a simple "sorry 350." The following day I emailed Dustin with a warning that if I did not receive my money that he rightfully owed to me, I would report this incident.
