Ripoff Took money to file for H1B visa. Did not file the visa and did not return the money

This company charged me for H1B visa and did not file the papers. I paid them $4000 for the visa unknowingly that this is the employers responsibility to pay for the expenses. During this whole mess, they never returned my phone calls.infact, it was only me who would try to initiate a communication. They are now unwilling to return my money that I had paid them. I am going to file a lawsuit against this company for the damages and the illegal visa activities that they do.
