Refused to honor contract and fix crack in wall he built saying it was cosmetic, wall has now completely collapsed

We bought a home from this builder in July. The house came with a 10 year warranty on the exterior. Within the first year we noticed a large crack that appeared in a retaining wall which held back all the fill/dirt that supported the walkway to the front door. We complained to the builder and asked him to fix it, he refused claiming that it was just cosmetic. The crack grew and we continually complained over the years until he refused to take our calls or answer our letters. Well the wall has totally collapsed into the front yard and he still refuses to honor the warranty in the contract or take our calls.
