Kleban Furniture Co Failed to provide furniture in a color sample chosen. Color not even close!

On October 3, I went to Kleban Furniture to order a custom dining room table and six chairs. I brought a sample drawer from a server which we planned on matching as closely as possible. The salesman helped us choose a sample finish from a choice of many. It was a pretty close match. We ordered the furniture and left a 50% deposit by check ($3700 full price). The check was cashed. When the furniture arrived, it was many shades too light (not like the sample), so I refused delivery. A few days later, we went to the store, only to be told that it was the lighting that made the furniture look different. The only thing that the store could do, was to re-order the furniture with a 50% restocking fee to the manufacturer. Kleban refuses to return our deposit and claims that there is nothing else that they can do.
