Takes 50% upfront at start, begins work, leaves for materials - never returns. Does not return calls

On June 1 I hired Michael Hans (Above the Top Lawn & Landscaping) to remove and rebuild a railroad tie retaining wall and replace five tons of crushed stone at the base. A contract was signed and 50% was paid upfront. Two workers started to remove old railroad ties and stone while Hans left to obtain the railroad ties. He returned at 9 pm to retrieve his workers, but without the rail road ties. He promised to return the following day but did not. Attempts to contact him all week with daily messages to his cell phone went unanswered.

A week later I made a complaint to the Middletown Police Department. They were successful in contacting him that day and Hans quickly called to say he would complete the job "next week". This went on for nine weeks of "next week" promises, including six specific days he said he would return - and I waited for him all day -to finish the job. At this point I am sueing him in small claims court to recover my up front deposit of $550.

The Better Business Bureau has 12 complaints against Michael Hans under the MGM company Name. Hans has not responded to any of the complaints and has an F business rating. The Middlesex Borough Police Department has also received numerious complaints about his business practices under the MGM business name. He appears to have now set up his little scam business in Monmouth County.
