Caribe Homes Developers Sales Person Is Javier Manager Is Raul And Mortage Broker Is Jerry Refuse to return deposit not qualify for mortage

March we make a deposit towards a new home. The primary buyer would be my husband and the cobrower would be my mom, when I met with the broker he said he was unable to qualify my mom and husband because he could not play with the numbers of their income and that they did not need any paper work for qualification it was just credit score that they use. He said that he was able to qualify me because i work for a Medical Institution and my income was more belivable. I really wanted this to work because my mom is retireing soon. I explain to the broker that our current home would have to be sold and so the contact must be contingent of this current contract. On 8/14/06 he called me stating the Chase bank approved me for a monthly mortage of $3999.00 per month and the perchase price of the home is $360,000.00.

I gave a cheque for $350.00 for an appraisal and credit report he said the fact that we were not qualified he would not deposit the cheque until he could find a bank that could work with us, this was July 06. I told him that I was not purchaseing a home it was my husband and mom there fore qualifying me was wrong and if they were not qualified he should state that to the sales person and close the deal and not qualified, he refused.

I contacted the sales person and he stated that we had thirty days in which to do all these things, I explain to him that I kept all the appointment that was given to me, I asked him to please refund our deposit, they never call us back we continouly call we get the run around, we visit the office we are told that the sales person in not in on a weekly basis. Septembe 2006 I discovered that they deposited the cheque for $350.00 after we faxed the cancellation of the sales based on that one good fath estimate, I called the sales office and they told me that neither Javier the sales person or Jerry the mortage broker was in they were at the new project (a new preconstruction)

I told the receptionist that to let him know that I will be comeing with a sign to get his attetion since he will not come to the phone or return our phone calls, well, to my surprise Javier came to the phone with and IRATE ATTIDUE if you come to this office he will call the police on me and he would have my legs broken.

The receptionist call me back told me that the person that I needed to talk with was the Manager Raul, he is no better they will not talk to me, that my name is not on the contract but I was the one who provided all the documents on behalf of my mother who resides in NY and husband. My husband called Raul he only provides one word answers and told my husband that the refund was denied and that there was not need for an appointment, if he need one to call back on monday when is secretary was in.

I contacted my attorney who sent a very stern letter requesting that he respond to the matter or face legal action I have yet to hear form both attorney or Caribe Homes. I will not stop.
