Construction & Repair

In November of the day before Thanksgiving; I purchased furniture from the Roomstore in Arlington, Texas. I purchased a sofa bed and chair. When the furniture was delivered, the delivery men were unable to get the sofa in the room that it was intended for. There is a light fixture in my hallway and I was told that that was the reason the sofa would not fit. They told me that when they angled the sofa it would break the light. They said they couldn't take it down due to policy. The delivery men assured me that the sofa would go in the room once the light fixture was taken down. I asked them several times if they were sure and they both replied yes. I believed them and told them to leave the furniture.

When my husband arrived home from work he told me that the sofa wouldn't fit in the room and that the delivery men pulled a fast one on me. I asked him to take the light fixture down and try to see if the sofa would fit. Well, it didn't and I was not happy. I entertained Thanksgiving guest with a sofa in my hallway!

I called the Roomstore the following day and explained to them what had transpired. I was told that they couldn't get the furniture until Monday. For five days my family and my guest had to maneuver around the sofa in the hallway. After waiting most of the day on Monday, I called delivery and was told that I was not on the list for a pick-up. Again, I called the Roomstore and they told me that they didn't know what had happened and that someone would pick the furniture up the following day (Tuesday); around 4 pm two delivery men came to get the furniture.

When I received a bill for restocking charges I was shocked. Restocking charges amount is
$700. I called the Roomstore in Arlington and talked to the manager who told me that he could not help me. He told me that I had to pay the restocking fee. I explained to him that the restocking fee cost more than the chair. I then called the corporate office and spoke to Ms. Garcia who told me that I would not have to pay the restocking fee. At this point I thought everything was taken care of.

I did not know if I returned the furniture that I had to pay restocking charges. I didn't have any intention of returning the furniture when we purchased it. ; if I had known that the sofa wouldn't fit in the room I would not have had my husband buy it.

Under the circumstances I don't feel that my husband and I should have to pay $700 for restocking fees.
