Installed new roof which has always leaked, says warranty is up after 1 year Ripoff

I had a new roof installed by J&C Roofing in spring of 2004. (The old roof never leaked, but original roof was old and needed replacing.) The new roof leaked whenever there was a heavy rain. Junior the owner came out several times to do repairs. At one point during warranty period, I showed him a lightly stained area on my bedroom ceiling by the skylight but it had dried and we weren't sure it was new so nothing was done. However, shortly after that, during another heavy rain, water literally poured in and flowed down the wall by that spot so I knew the new roof was leaking. I called Junior. He sent a worker out to repair it, but in the next heavy rain when that part of ceiling got soaked, I discovered that leak hadn't been properly repaired. I have called Junior numerous times over a several-month period to report this leak and each time he tells me he'll send someone out but no one comes. The roof leaks during every downpour.

Now the ceiling and wall have developed dark brown stains from the leak and there is a mold problem so that I cannot even sleep in my own bedroom because of a severe allergic reaction to the mold. I called Junior twice in the past week about this. This morning, Nov. 16. I asked when he'll repair it and he said he'll have to charge me since it is no longer under warranty.

Since the roof has has numerous leaks since he installed it, I feel that the workmanship was shoddy and unacceptable. A new roof shouldn't leak once, let alone every time there is a heavy rain. I feel he should repair it for free and maybe even redo the roof since it has always leaked, or else refund my money so that I can get a more competent roofer to do the job. I shouldn't have to pay to repair a new roof that has always leaked.
