Looks like bait and switch ripoff by gmac

Like a lot of American families, we got into financial trouble. I had gotten injured on the job, and I was Head of Household. My husband has been self employeed for many years.

We were contatced by a company offering us a solution for our mortgage issues. It ended up turning into a referral to a bankruptcy lawyer. Never having gone through this before, we did everything we were asked to do, after all we had to save our home of 7 years. Being misled into the wrong chapter of bankruptcy was bad enough, ending in dismissal as we were expected to pay over $1,100 a month.

On February 5th we began calling GMAC. We asked for help, options. Of course being passed on to another person, my husband called repeatedly to get neccessary paperwork for us to save our home somehow affordably. Almost 1 month later on March 1st 2004 we finally received a letter from GMAC.

The letter had listed the possibility of a hardship case. So I wrote our letter of hardship, and any other information they needed my husband faxed to them. WE COMPLIED with what they asked for!

OUR HARDSHIP WAS DENIED WITH NO WRITTEN REASON! Now seems to me if you are denied even a credit card you by law have to be sent in writting reason why you are denied, however GMAC baited us in with the hardship case possibility knowing our situation, then denied it and did not disclose why. They offered us a forebarance in the amount of over $1,300 a month. They knew it was impossible for us to pay that amount.

Date of Foreclosure April 2nd our home of 8 years by then had supposedly gone up for auction. Then September 9th we receive a notice from GMAC in VAN NUYS, CALIFORNIA saying we had no insurance on our home and loan number included. Well we had been forclosed on why insure it? We had already lost everything we had paid into it in mortgage payments and in repairs and updates. I WAS FURIOUS!

SO I decided to look into this foreclosure 6 months later, here we are into October calling our REGISTRAR DEEDS, OUR DEED SAYS NOTHING ABOUT BEING FORCLOSED ON, OUR NAMES ARE STILL ON THE DAMN DEED!

I am so angry about all of this garbage I could just spit nails! MY FAMILY needs help! This is unjust, and somehow GMAC AND FIRST MORTGAGE needs to be taught a lesson. I will not be baited in and screwed over and accept it!
