Ripoff, i'm going to court on monday after 9 months!

I have read all the negative about Capital One and the same has happened to me. First a charge went thru that put me over the limit and in just a couple of months it was so out of control I could not pay, as you know fees for fees. $600.00 credit limit and now $2002.35. Purchase 1,153.87, Payments 965.00, Balance 188.87!! Over limit - 547.00, Past Due - 533.00, Member Fee - 40.00, and Finance 400.59 total fees - 1,520.59.

Sent to first collection company - Sent letter dispute debt wanted copies of some of the statements, instead sent to second collection agency NCO Financial, disputed within 30 days and wanted copies, before 30 days was up sent to Attorney, BURNS, BURNS, WALSH & WALSH in Lyndon, Kansas. Responded in 4 days disputed charges, said statements would be sent, Feb 9 emailed hadn't received, replied they are ordered. May 31 next contact being served summons to appear in court on 6-21-04.

They will not settle for anything less than the $2002.35 they will take payments but will also charge me 25.9% interest and will have the judgement against me. I have filed a complaint with the FTC, the Kansas Bar, the Attorney General regarding these practices. They are in violation of Sec 809 of the FDCPA continued collection of debt in dispute. I only hope the judge will cut me some slack on Monday. Any help will be appreciated.
