I bought a Nissan Pathfinder in April. Within the first year I had the truck in for service 11 times, first time was within a few days of purchase. My truck was deemed a lemon, and when I tried to exercise my rights under the lemon laws of maryland, I was shafted. They wanted me to pay an additional $7000.00 plus keep all the payments I had already made, in order for them to "buy back" the truck. There was no fairness there. A lawyer tried to settle for $5000.00, but after I signed an agreement for an extended warranty, they refused to pay the $5000.00 and honor the extended warranty.

To make matters worse, I have paid weekly on my loan, and made payments over and beyond the amount required, to the point of having my payments not due for another year. Recently, I discovered that all of my payments have not been recorded on my statements.in July, I made 6 payments during the month, and Nissan only recorded 5 payments. The August statement did not reflect this payment either. When I called Nissan today to show me the accountability for the missing payment, they showed they received it on their system, but could not explain why it did not show up on the statement, or reflect in the pay-off balance provided. The customer service rep wanted to send me a copy of my payement history, but said she could not address the missing payment.

When asked how this was to be addressed she referred to sending me the history again. I explained that we had now identified a specific error, that needed to be corrected. With no resolve from her, I asked what was the protocol for problems like this. She gave no reply. I explained this warrants a "lawsuit", and that someone in the higher corporate section should be notified that a problem exists. What do I have to do I asked? She said you would have to request to speak to a supervisor. I said, Well, Can I speak to a supervisor? She put me on hold and after about 10 minutes the call was disconnected.

I have had several issues with Nissan Motor Acceptance, such as the above mentioned, and also the application of interest, after principle payments are made specifically, to reduce the principle which in turn should reduce the interest. After carefully reviewing my payment history, and my sales contract, it would appear that my car will be paid off approximately 2 1/2 years ahead of schedule. Having said that, anyone with any kind of " math skills would know that my total pay-off for the vehicle will be considerably less than the contract states for a 72 month loan, because of paying it so far in advance. According to my calculations though, it would seem I am paying the same amount of money, but in a much shorter period of time.

There is no evidence of any monetary benefit to paying off this truck 2 1/2 years early except for my debt liability. There is something terribly wrong here, and I have asked Nissan on 3 occassions to have someone audit my account, and to explain to me what is going on.in addition, a $5000.00 payment sent my "payment due date" ahead by one year, but after I complained that this payment was supposed to be towards the "principle" not P&I they made an adjustment. But get this... They applied the payment to the "Principle" only... However now I owe more than one payment, and my payment is now late, so they said. When I asked about the fees that were charged for "interest" during that time, they said they were a part of the intrest fees charged. I could not reason with them. They did not understand that I would have been entitled to all of the interest charges charged during that period of time.

To this day these issues are still not resolved, and no one has taken a genuin interest, and put this complaint in the corporate lap of a company executive.

They have stolen from me, and I wonder how many others they have ripped off. There is a lot of information to get out about my story, and I hope for those of you reading you were able to follow me... The moral of the story here, check you payment history to see if you too have ripped off, and stolen from.

If anyone knows of an effective way to resolve this type of conflict please let me know as soon as possible. They are getting away with a corporate financial crime, and if they won't deal with it, maybe it is time to go to the authorities.

As consumers, we must stop businesses like Nissan Motor Acceptance from ripping us off and taking what is not theirs. If you have been ripped off, fight for your rights.
