How can GMAC continue to foreclose with little to no help

My husband and I had moved out of our house and rented it out, but were still losing $500.00/month out of pocket. We relocated to try and help my family with some problems. My husband was not able to find a new job and was unemployed for two months as was I. We moved from Texas to Kansas and the job market was horrible, so we struggled to keep up. GMAC sent us a letter offering a forbearance for two months, and we had no other option at that time. Then in December we were informed we were behind 2 months and they were going to foreclose on our home. GMAC suggested we do a loan modification. Long story short we were was denied 4 times, the reason for the last two denials were lack of income. We moved back to Texas and found great jobs and wanted to save our home. We now have combined income of over $150K per year and stable jobs so we can afford a $1500 dollar payment. It turns out that were were actually denied because were not living in our house. So our last denial for modification was too close to the sale date of April 5th to do anything. Had we have know the denial and lack of help was due to us not living in the house we would have moved back in to our house in order to get some help. I have spent so much time on the phone with GMAC, emailing, talking to lawyers, trying to find a way to save our home, but now HUD is taking over the home from GMAC. I just don't understand why GMAC wants our house when we can afford it. It is over 50K upside down and will never sell in our neighborhood. I am so pissed, shocked, hurt, and angry and how GMAC treated us and it turns out so many more American's have been ruined by GMAC. I want to sue GMAC but we can't afford to waste the time and money when it wont even ensure we get our house back.
