I have experienced since 1996 almost all the violations complained of and more. I just refinanced with a local lender which is my first piece of gratuitous advice - deal with people you know.in order to obtain a discharge, I had to overpay HomeQ by several thousand dollars in illegal fees added on one week before my refinance closing and after I requested an accurate payoff and complained to OCC.
I almost lost the new commitment because of HomeQ but I managed to scrounge up enough to cover so that I can pursue them with "clean hands". My second piece of advice - complain to OCC which really doesn't do anything but might if it had to do some real work because of a large number of complaints, in particular Elden Weiger, Bank examiner, so that one person gets a bunch of them. Also contact your state attorney general, you can usually file a preliminary complaint online.
Keep all your correspondence and documents and make notes of all phone conversations, date, time, with whom. Always get a name when you talk to someone. I intend to bring an action to obtain my overpayment and other damages. If the usacomplaints.com Lawsuit link gets up and running I will see if I can post information as things progress. I intend to investigate thoroughly. These companies prey on those least likely to be able to afford to pay and least likely to know what to do. This may sound silly in this day and age but I feel I have a moral obligation to go after HomeQ and cohorts.
