Prepayment penalty of $7,603 charged with no rider on mortgage

My mortgage was sold to this ripoff company shortly after my husband and I modified our construction loan.

1. They are trying to charge us a prepayment penalty of $7,603.01 when there is no rider to our mortgage. If there was a prepayment penalty, then they should have had us sign a rider at modification, just like every other paper they had us sign. I looked for that, because when we took out our construction loan there was a prepayment penalty, so when it came time for modification we advised our broker that we would take our mortgage somewhere else if there was going to be a prepayment penalty. He then advised us that due to the LTV there would be no prepayment penalty.

2. They ordered the documents to verify this information, and then when they got the documents in, their excuse is that the document was not sent to them with all the other documents, so they will need to order it from another source. This is bogus. If there was a rider, then it would have been with all the other documents in storage.

I hope that something is done to this company for trying to rip off or just get rich quick from their customers, who never chose to be with this company.
