I have my mortgage with Conseco Finance. I took over the home a year ago, after my co-applicant fell behind and the home was almost foreclosed. I made good on the mortgage, however there were some problems with incorrect billing. After being put in touch with the person who would be handling the account, my life was instantly thrust into hell.

For the first three months, people were coming to the house to look at it as perspective buyers, because Conseco had incorrectly listed it as for sale. At one point, two men showed up as well saying they were there to clean the property up. I informed them of the situation, as I had spent 3 weeks cleaning prior to even being able to move in (I also took pictures as evidence). I called this "person" at the mortgage company, explaining what was going on. I was informed by him that I was trespassing and I needed to move immediately. After several phone calls and hours later, He "allowed me to stay".

The mortgage statements that I was receiving were wrong and each month showing that I was owing almost $2000.00 each month. Again I contacted this individual. We went over the account, and it was discovered I was being fradulently being billed for the "house cleaning". When I told him this was incorrect and that we spent weeks cleaning the house, and about the day the men came to my home, he told me I was lying and that I was a liar. For now the charges would remain, and that if i was to keep my home I would call him each month, and he would tell me the amount due for that month and I would send the check or money order to the office located in Kennesaw.

For some reason, still unexplained to me, my mortgage fell a month behind and I decided to make another 45 minute drive across town (We had already been driving the payments to the office and trying to get the account charges straightened out). At this point, the individual met with me and my parents, as I had already felt I needed a witness to his verbally abusive tactics. We showed him the pictures, the charges were reversed, and he never has apologized for his behavior regarding this. I was given an extension on my account, instead of an explanation as to why it was behind. Also I was told that my monthly charges would go down by half, for a period of six months. (due to my being on disability).

Seven months later, the payments have fluctuated up and down, and because of his promise never being fulfilled, I fell a month behind. Being true to past form and habit, I would continuously get calls, alternating from my home phone to my cellphone, all day long, every day, 7 days a week, beginning at 8 am.

Once again, I called the individual at the mortgage company, at this point, I had become one month and $165.00 behind. He told me that I needed to pay the 165.00 immediately, or he was going to "evict" me. I was forced to give him a check over the phone, post dated for the end of the month. I had taken a job to catch up on my bills, however, I was unable to perform the work because the physical requirements far outseeded my abilities due to my health, and I lost my job after a week.

Afraid to call and let this "collector" know my situation, I waited a week. When I spoke with him, he told me to "pack my things and get out", because he "was sick of me". He berated me for several minutes, before I finally lost my calm for the first time ever. He refused to give me his supervisor's name, and stated that "he would tell me the same thing." I admit I did use some choice words, and informed him that he was to no longer contact me, and I hung up. He called back 3 more times. Also informing me, he "would not send a default notice, that I just need to get out of the house". I had always kept my end of these agreements with him and was consistent. When he failed to hold his end, that is when I fell behind on my payments. No mention has yet been made regarding the full month, only the 165.00 which will be due on the 26th.

I am now in the process of packing, I would rather have a foreclosure than to continue dealing with this type of abuse from anyone, especially from someone, whom I barely know. I have made phone calls, sent letters and emails, yet I cannot get anyone to return my correspondence.
