Late in depositing funds & created overdrafts

Based on the agreement I've with CashNetUSA, these were to deposit resources into my consideration on August 4. The agreement does suggest that they're not responsible for overdue remains for activities beyond their handle for example lender mistakes, vacations, etc. plus they also report your being overdue in supplying extra information for example paystubs and that's all-they record. I utilized after which immeidately via fax and e-mail delivered the necessary paystubs. AFter not reading from their store I resubmitted the paystubs with another mail. I subsequently obtained a notice showing the deposit might occur on August 4. On August 4, no-deposit and many of my inspections struck the consideration making $140 in facility charges. I subsequently obtained a contact morning hours August 5 declaring they could be late adding the resources. At that time, the resources were within the consideration, but I still experienced the overdrafts, the entire reason behind getting out the mortgage within the first-place was to prevent these overdrafts. Today I've the OD costs in addition to the mortgage costs for nothing.

I approached them plus they WOn't recognize the agreement declaring the mortgage isn't good before resources are transferred in to the consideration. I understand that there's a recission term within the agreement, however, you just have before period the resources have been in the consideration. From the period I acquired the e-mail that it had been overdue, the resources are there, therefore recissioin period was over. Anyhow, they didn't fulfill their contractual responsibilities by adding by July 4 and therefore are declining to pay or credit me the $140 in facility charges they triggered.
