Back out of refund agreement from Escrow

Last February I refinanced through Mortage Broker Dan Hanley who worked for Fivanta. He originally brokered the loan that we got last November. Around December he called me and said that he could help me lower my monthly payments by refinancing right away. I consulted with my wife and we agreed to the refinancing. One of the conditions we agreed as that Dan Hanley said that he would waive the $595 processing fee from Fivanta and he would pay us back that $595 once escrow closes. I wanted to initially take that $595 fee out before escrow closed, but Mr. Hanley said that it would cause delay and the sooner we close the deal the better for me. Luckily my wife, got him to put the promise to pay the $595 down through email. He assured my wife that he would waive the fee and that refinancing would help us a great deal. I was really happy because it did save us money. However, Dan Hanley and Fivanta never GOT me my $595 check. It's been 4 months. I emailed him around beginning of March and he said that he'll get me the check. Well April came by and the check did not arrive. I called him and emailed him and he would not RESPOND BACK. I wrote him a lengthy email asking for an explanation because I was really dumbfounded as to why he would not return my emails and calls. I told him that I thought we we had a good working relationship and that I trusted him. Well he finally responded and said he apologized and he was embarrassed. He said that he has been "fighting" with Fivanta regarding our check. But he said that we would make things right and that he would give me the $595 out of his own pocket. Well that was last April. It's now June. I have yet to receive the check!!! I called and emailed him. He responded around early June and he said that he would still pay me and that I would get the check. Well it's middle of June and there is still no check!!! I guess I fell for the old bait and switch technique that a lot of unscrupulous lenders are doing. I truly trusted Dan because he really did help us make our first home purchase a reality. But to me a deal is a deal. I just hope that he finds it in his heart that he made a mistake and what goes around comes around. The funny thing is that my wife expected that this might happen. That we might get screwed. So we prepared ourselves. But we wanted to give Dan and Fivanta the benefit of the doubt and do the right thing. Well apparently, being nice and reasonable did not pay off.
