Failed to provide financing and return deposit

Jim Haggen, Pres., Discount Capital promised a sale / leaseback financing arraignment for us but will not deliver. He is not available by phone, will not return messages left, and will not return our $4900.00 first/last months deposit. His staff[Molly, Reston, Valerie] are just as clueless and vague. They all blame it in the market, the economy, the funding department, etc. We have a signed contract that is worthless. Be careful as they are very friendly when getting set up, but become very vague as to the details and closing any deal, the timing and the actual funding are hard to pin down. We have been waiting for almost two months for some resolution.
