Ripoff Company Has all my payments but still trying to Foreclose!

I don't even know where to begin with this company. On Oct. 1, we were served with foreclosure papers from Fairbanks. We thought there had to be some kind of mistake. I contacted Fairbanks but it was a joke because nobody at Fairbanks knows what the HECK they are talking about.

Then about a week later I starting receiving my mortgage payments back. Needless to say I was first told that my payment was not enough because I had placed insurance on my home for the second time. We carry our own insurance and it has been with the same company since we got our loan.

I was told to return all my payments and in November Fairbanks accepted all my payments back I thought that was the end of it. Was I wrong! These fees went into some kind of *SLUSH* fund and were eventually credited to my account.

In December we went to court for the first time and informed the judge and Fairbanks lawyer that Fairbanks had recieved and cashed all my payments. The lawyer was unaware of this and we got a continuence.

Fairbanks has tried numerous times to get us to sign a Forebearance plan and I refuse because we have *NEVER* been delinquent and I am not paying all there outrageous fees.

On March 10 we went to court for a Final Judgement and Fairbanks lawyer never called so our case is still open. Then to our suprise on April 8 Fairbanks sent someone out to change our locks on our home. Needless to say this did not happen. Since then I have been trying to contact Fairbanks to speak with another Supervisor because you never speak with the same person.

I have left numerous messages but no one returns our calls. I am begining to think this is because of there *LACK OF EDUCATION* they don't know how to check their messages because almost always the mail box is full. We plan on joining the CLASS ACTION LAWSUIT against this company.
