Debt Marked Uncollectable Despite Promise It Would Be Marked Paid

While going through a divorce in 1998, I owed approx. $1000 dollars to Beneficial (later bought by Wells Fargo). I was 30 days late and was contacted by their collections department. After explaining my rough time, I was told that if I made a partial payment (of a few hundred dollars), that the debt would be marked as paid and that the account would be closed.

The debt was not marked as 'paid' but was instead marked as 'uncollectable' and I have had nothing but problems since.

First of all, they reported that I owe the money even though they said it would be marked as 'paid'. Next, when Wells Fargo bought the company, they attempted to collect again (harassment according to FTC guidelines.) When I contacted them about the harassment, I was told AGAIN that my debt would be marked 'paid' which is was not.

Finally, after all of this time, I contacted them AGAIN and offered that I would pay some fraction of whatever is left if they would agree not to report anything to the credit bureau and if the credit bureau calls, they should say that my account is 'unverifiable'.

I was told that doing so would be fraudulent and that if I paid the entire amount, that they would mark my debt as 'paid'. So, my credit report would say that my debt was only 5 years late? That still hurts my credit report.

Do NOT do business with these people... They lie whenever it suits them. The credit department is pig headed. (They could have made a couple more hundred bucks from me and I would be happy, but instead, I'll wait the 2 damned years for it to get off my credit report so that these guys will NEVER get another red cent of my money.

I contacted a lawyer and since I don't have the original agreement in writing, I don't have a leg to stand on to sue them, but I want to warn everyone else.
