B Deliberately delaying the process of received payments in order to charge a late fee

Mortgage payments owed to AHMSI have a 15 day grace period. After that 15 day period elapses, a late fee is charged by AHMSI.

I have been a customer of AHMSI for over 2 years. I mail the check to AHMSI during the 1st week of the month, and the checks always clear my bank prior to the 15th. After making 28 consecutive payments on time, I was charged a late fee in connection with my August payment. I contacted AHMSI and questioned the fee, and spoke with a supervisor. The supervisor advised me that nothing could be done. According to my records, the check cleared my bank on 17th.

I mailed my September payment again during the 1st week of the month. Along with my payment, I included a check for the late fee as well as a note questioning AHMSI's practices. My check cleared AHMSI on September 16, again resulting in a late fee. I called AHMSI several times to talk to someone, and was disconnected each and every time.

It is my belief that AHMSI is engaging in a practice of holding payments so that they are deemed received by AHMSI after the grace period, resorting in substantial income for AHMSI. For example, if it delayed processing of 1,000 customer payments so that it would be able to charge a late fee for $100.00 for each, that would result in a $100,000.00 windfall for AHMSI.

This type of conduct is an unfair trade practice, and constitutes wrongful conduct on the part of AHMSI.
