EquiCredit Corporation Fraudulently declared a foreclosure despite current payment status Rip-off

I am having problems with Fairbanks Capital Corporation. Here is an email I just sent to the consumer advocate at WPXI Television, Channel 11 - NBC affiliate, here in Pittsburgh. Feel free to share this message with whomever you wish.

Fairbanks Capital Corporation is a mortgage loan servicing company headquartered in Salt Lake City, Utah. It has operations in Louisville, KY, Jacksonville, FL, Pasadena, CA, and I believe also in Harmer, PA. It assumed my mortgage from EquiCredit Corporation about 2 years ago.

The company engages in all sorts of illegal and unethical practices: misapplying mortgage payments, charging exorbitant or fraudulent fees, misrepresenting amounts owed, harassing mortgagees, holding checks for a week or more to ensure that the payment is late (to charge late fees) falsely accusing mortgagees of not having made payments, etc.

It always works out that the borrower can produce canceled checks, money order receipts, ACH acknowledgments from one's account statements showing that billed payments have been made, yet no matter what the borrower is always behind and the company continually harasses and threatens mortgagees. This has been my personal experience, which seems to coincide with that of many homeowners across the country.

There are complaints and investigations all over the country about and of Fairbanks.in early December Fairbanks threatened to foreclose on my mortgage yet I can document that my payments were current at the time of the foreclosure notice and they remain current to this date.

Then they have this telephone "goon squad" called the Loan Servicing Center whose job is to call people up, harass (i.E., shakedown) them for payments either not owned or already paid. I will refer you to a couple of websites and I will be happy to speak with you about this matter on the air if needed. I am working with Greg Simmons of the Pittsburgh Community Reinvestment Group to help me resolve this matter.

Fairbanks Capital Corporation is, at the very least, an unethical company engaging in bad business practices. At the very worst it behaves like a sleazy loan shark front for organized crime. This is the third house I have owned in my life and I have never had these sort of problems with any mortgage loan servicer ever!

Fairbanks Capital Corporation has messed with the wrong person this time! I have declared war on this hoodlum company and I plan to win it and make the spirit of Sun-Tzu ("The Art of War") proud!
