Walter Wronka Discrimination, fair credit reporting act violations, lost payments

Cendant Mortage (now PHH) purchased my loan and I've had nothing but issues ever since. I have had payments not applied properly. I made photo-copies of payments and sent proof to no avail. My credit report contains information they admit is inaccurate. They acknowledge owing me money but never send checks.

They returned every payment I made between September and December after holding the payments for weeks. No interest, no credit for making the payments. When I asked why the payments were being returned it took months for them to answer my emails.

I have been told I have a single point of contact at PHH named Walter Wronka. He refuses to respond to emails or phone calls. He does not answer questions about the servicing of my account. He refuses to admit any errors or fault on the part of PHH mortgage. He has lied, broken commitments, falsified documents, lost records of phone conversations, etc.

I have sent in 27 cancelled checks (my payment is @$920) that they have not applied to my account, yet he refuses to take action. My bank has sent letters and faxes, including certified mail, but they do not acknowledge receipt.

They have attempted to foreclose multiple times, despite evidence that they have received and processed payments. I can get zero assistance from anyone in the company. I have sent emails online through their website, sent emails to loss mitigation. The person over loss mitigation (his name escapes me at the moment) told me if I call him for help again he will block my number from being able to call them. I called him 3 times total when he told me this.
I stopped the foreclosure the first two times by remaking payments I already made under protest and durress, with agreement from their counsel that a full review would take place once the foreclosure was off the table. The full review never took place.

I encourage everyone to stay away from this company, avoid doing business with them.

I am currently working with a local attorney, my state's banking office, and HUD to try to get resolution. Hopefully PHH will be permanately shut down when all is said and done.
