False Credit Report, Payments not credited, foreclosure begun ripoff

Like several of you I am doing battle with GMAC Mortgage. Dec. 3 they mailed a letter to me stating they were beginning foreclosure in 30 days due to none payment since Feb. 2006. They wanted almost $4,000.00 in payments, WAY more than the supposed number of missing payments were for, PLUS almost $4,000.00 in penalties, interest, and "assoc fees".

I didn't get the letter until Dec. 10. I responded immediately via telephone. I was told the letter was incorrect. They had not gotten a payment from me since June. I told them I would fax proff of payments right away to clear this up. I was given a fax number and a name, neither were provided on the letter. I faxed a reply letter with proof of all payments, followed that with certified mail proof and a letter demanding to know exactly what payments were missing. On my next phone call I was told to have my lawyer contact them, they prefer to deal with my attorney "in these matters". What the hell?! I have positive proof of ALL payments going back into 2003.

They simply don't care and don't want to hear it. They will not respond to my written or telephone inquiries. Now I have hired a lawyer. HELP! Any Class Actions or other actions I can take?
