My mortgage was sold to, or assumed by, Ocwen Federal Bank FSB. From the outset, I have had problems with them. At one point, I reached an agreement for payment of an arrearage, some of which was seemingly legitimate and some of which was seemingly not legitimate, just to get them to start a-new. As soon as I did this, the person with whom I negotiated the agreement vanished.
I made my first payment after the agreement, and they sent it back. I called the person who had negotiated the agreement and she was gone but a new person, who would not give her name, said that I was 'one payment ahead' because of the agreement and that's why they sent the payment back. Several months later they started showing me as one month behind and I would write and ask why and they would send form letters or I would get a letter from their attorneys saying I was in default.
I would send my payments and they would still send these letters. Now, in June of I finally get a letter stating that they claim to have not received a payment in April of 1999. At the same time I got a letter stating they did not received the May payment — which cleared the bank two weeks before the letter denying receipt of it was written. I cannot make heads or tails of their accounting/notice/credit/debit practice AND I AM AN ATTORNEY MYSELF!!!
They truly seem to be doing this only to make exorbitant fees; and, if there is a rhyme or reason to how they assess those fees, they seem reluctant to say what it is. I have yet to even receive a letter with a SIGNATURE on it, and most letters don't even bear a name of the sender. If I practiced law like this, I would expect the Bar to be hot on my tail! If their actions are justified, I have yet to see proof of it!!!
